The fifteen innovators shared the prototypes they've created and reviewed feedback from their first testing phase. They have some great ideas on how we can improve the credit union movement. We can't wait to see their presentations at the Iowa Credit Union Convention in September!

Legal Tip: What to Know About Iowa Authorizing Custodial Trust Accounts
BHM Logo

Iowa’s recently created Uniform Custodial Trust Act goes into effect on July 1, 2021, and allows for gifts to be made to adults - similarly to gifts made to minors under the Uniform Transfers to Minors Act. Your credit union should be aware of requests for accounts under the new law for litigation proceeds, and for gifts or bequests to vulnerable adults who may not be qualified to manage the assets but who are not subject to a conservatorship. A custodial trust for an adult must be created in writing, with a designation similar to the below:

  • A gift or transfer upon a future event (description of the property and triggering event), to ____________(recipient) “as custodial trustee for _______________(name of beneficiary) under the Iowa Uniform Custodial Trust Act”

Custodial trusts opened under the new Act should designate both the name of the custodial trustee and the beneficiary. Although the beneficiary is an adult, a beneficiary’s durable financial power of attorney is not effective to terminate or direct the distribution of funds held in a custodial trust account. Questions? Contact Elizabeth Hodgson or Julie Buenzow.
